Budimex Seeks Legal Recourse After Exclusion from Czech D11 Motorway Construction Tender

Budimex, a Polish construction firm recognized for its role in developing high-speed rail infrastructure in both Poland and the Czech Republic, is not backing down after being excluded from the tender for the construction of the D11 motorway from Trutnov to the Polish border.

Despite decisions by both the Czech Road and Motorway Directorate (ŘSD) and the Office for the Protection of Competition (ÚOHS) against the company, Budimex is to challenge the rulings. The company has confirmed its intent to pursue all legal avenues to defend the validity of its tender documents, keeping the project start date uncertain.

As previously reported by RAILTARGET, Budimex has been actively seeking to expand its operations into the Czech Republic, using its experience from large-scale infrastructure projects in Poland. The company's strategic focus on the Czech market, particularly in highway and railway construction, has faced challenges, including difficulties in forming partnerships with local suppliers. Despite these obstacles, Budimex has remained committed to establishing a stronger presence in the region.

With the exclusion from the D11 motorway tender, Budimex's next step could involve filing a complaint with the chairman of the Office of Competition and Consumer Protection. Should this appeal be unsuccessful, the company may escalate the matter to the courts. Meanwhile, the Czech authorities, including ŘSD, must wait for legal proceedings to conclude before moving forward with the project.

The tender for the D11 motorway ultimately went to a consortium of Czech, Slovak, and Hungarian construction companies, which offered a bid slightly higher than Budimex's. As the situation remains unresolved, the timeline for beginning construction on this infrastructure project remains uncertain.
